Scope of Application

These Terms and Conditions (T&Cs) apply to the purchase of products in the TROLL NATURFÄRBEREI® online shop and to all other services provided by TROLL NATURFÄRBEREI®.

The drawings, illustrations, images, sample collections, specifications, technical data, weight, dimensions, and performance descriptions displayed by TROLL NATURFÄRBEREI® are non-binding. Deviations between such information and the final product may occur.

TROLL NATURFÄRBEREI® reserves the right to amend these Terms and Conditions at any time. The version valid at the time of the order shall apply. Such version cannot be unilaterally changed for the respective order. Any terms and conditions of the customer that conflict with or deviate from these T&Cs shall not be recognized.

1. Orders and Conclusion of Contract

The presentation of products constitutes an invitation to submit a purchase offer in the form of an order. By submitting a purchase offer, the customer simultaneously accepts these Terms and Conditions.

Acceptance of the offer by TROLL NATURFÄRBEREI® takes place by means of an order confirmation sent via email. By ordering goods or services from TROLL NATURFÄRBEREI®, these Terms and Conditions are deemed accepted.

Any agreements that deviate from these Terms and Conditions, in particular verbal or telephone agreements, shall only be valid if expressly confirmed by us in writing.

TROLL NATURFÄRBEREI® expressly reserves the right to reject the conclusion of a contract, particularly in the case of unusually large order quantities.

If an offer is not accepted, the customer will be informed by email within a reasonable period. Such notification shall be legally effective even if a confirmation email has previously been sent.

2. Minimum Order Value

There is no minimum order value at TROLL NATURFÄRBEREI®.

3. Prices

All prices are stated in CHF (Swiss Francs). Errors and price changes are expressly reserved.

4. Shipping and Costs

For each delivery within Switzerland, we charge a shipping fee of CHF 9.00.

If, for technical reasons, we deliver your order in several shipments, the shipping fee will naturally only be charged once.

For orders from outside Switzerland, shipping conditions must be requested separately. Any customs duties, taxes, or VAT charges shall be borne by the buyer.

For environmental reasons, we use recycled cardboard and eco-friendly packaging materials.

 

5. Delivery

Delivery shall be made to the delivery address specified by the customer.

All delivery times stated are approximate and non-binding. We deliver via postal services or parcel carriers.

Please note that our products are not mass-produced items. Therefore, longer delivery times cannot always be avoided. In such cases, we may also fulfill your order through partial deliveries.

TROLL NATURFÄRBEREI® places great importance on keeping product availability and delivery times in the online shop accurate and up to date. However, production issues or supply shortages may result in delivery delays.

Therefore, all information regarding availability and delivery times is provided without guarantee and may be changed at any time.

6. Payment Terms / Retention of Title

Orders are shipped via PayPal payment or against advance payment.

The goods remain the property of TROLL NATURFÄRBEREI® until full payment has been received.

7. Liability

Customers must inspect delivered or collected products immediately upon receipt for correctness, completeness, and any transport damage.

Any claims for damages, regardless of their legal basis (including claims arising from negligence during contract negotiations, breach of ancillary obligations, tort, or other statutory claims), are excluded.

At the sole discretion of TROLL NATURFÄRBEREI®, liability shall be limited to repair, replacement, or reimbursement of the invoice value of the defective goods. Any further claims by the purchaser are excluded.

In particular, TROLL NATURFÄRBEREI® shall not be liable for damage resulting from improper use, failure to follow instructions for use, normal wear and tear, or damage that does not affect the delivered product itself (consequential damages).

Any modifications or repair work carried out without the written consent of TROLL NATURFÄRBEREI® or the manufacturer, as well as any non-compliance with these Terms and Conditions, shall void all warranty obligations.

In all cases, including services provided, liability for slight negligence is excluded.

As our products are not mass-produced items, minor deviations from product images and descriptions may occur. We accept no liability for such deviations.

TROLL NATURFÄRBEREI® shall not be liable for events of force majeure, including but not limited to natural disasters, moisture damage, impact damage, fall damage, or similar events beyond the control of TROLL NATURFÄRBEREI®.

8. Right of Return

If you are not satisfied with a delivered item, you may return it within five days of delivery, provided that it is unused, in perfect resalable condition, and in its original packaging.

Cut-to-size goods, custom-made products, and individually manufactured items are excluded from the right of return.

Returns are made at the customer's own risk and expense. Return shipping costs shall be borne by the customer.

Sale items and products specifically marked as non-returnable are excluded from the right of return.

9. Data Protection

10. Resellers

TROLL products may only be resold by resellers upon prior agreement and only in the same form in which they were purchased, either as individual items or as complete sets.

Certificates and folded information leaflets are an integral part of the products and must not be removed before resale.

11. Applicable Law and Jurisdiction

All contracts and orders concluded or placed on the basis of these Terms and Conditions shall be governed exclusively by Swiss law.

The place of jurisdiction shall be the District Court of Hinwil (ZH), Switzerland. However, we shall also be entitled to bring legal proceedings at the purchaser’s place of residence or at any other legally competent court.

Should any provision of these Terms and Conditions be invalid or unenforceable, this shall not affect the validity and enforceability of the remaining provisions or of these Terms and Conditions as a whole.

All rights, in particular copyright and intellectual property rights relating to these Terms and Conditions, belong exclusively to TROLL NATURFÄRBEREI®.

Any reproduction, distribution, or other use is prohibited and is only permitted with the express prior written consent of TROLL NATURFÄRBEREI®.

In the event of any violation of this provision, TROLL NATURFÄRBEREI® reserves the right to take all available legal action.
